These Terms of Service (“Terms”) govern your access to and use of the Make Image Transparent website, web application and browser extension (together, the “Services”) provided by Make Image Transparent (“we,” “us,” and “our”).

By accessing or using the Services, including by uploading an image, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree to these Terms, please do not use the Services.

Eligibility

The Services are intended for users over the age of 18. If you are under the age of majority in your jurisdiction, you may use the Services only with the permission and supervision of a parent or legal guardian. The Services are not directed at children under the age of 13.

The Services

Make Image Transparent lets you remove the background from images using artificial intelligence. The Services are currently provided free of charge and without an account. To keep the Services available for everyone, we apply usage limits (for example, a maximum number of images per day, a maximum file size and a maximum image resolution). We may change these limits at any time without notice.

We may modify, suspend or discontinue any part of the Services at any time, temporarily or permanently, with or without notice.

Your Content

You keep all rights you have in the images you upload (“Your Content”) and in the processed images you receive (“Output”). We do not claim ownership of Your Content or the Output.

By uploading Your Content, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, transmit, process and modify Your Content solely for the purpose of providing the Services to you.

You represent and warrant that you own Your Content or have all rights, licenses and permissions needed to upload it and to have it processed through the Services, and that doing so does not violate the rights of any third party (including copyright, trademark, privacy and publicity rights) or any applicable law.

Acceptable Use

You agree not to use the Services to:

  • Upload, process or distribute content that is illegal, including child sexual abuse material, or content that is defamatory, harassing, hateful or otherwise harmful.
  • Process images of other people without their consent where such consent is required, or create content intended to deceive, impersonate or harm others.
  • Infringe the intellectual property, privacy or other rights of any third party.
  • Access the Services through bots, scripts, scrapers or other automated means, or call our servers other than through the interfaces we provide.
  • Circumvent, disable or interfere with usage limits, security features or other restrictions of the Services, including by rotating identifiers or IP addresses.
  • Reverse engineer, overload, disrupt or attempt to gain unauthorized access to the Services or the systems they run on.
  • Resell, sublicense or offer the Services to third parties as your own service.

We may restrict, suspend or block access to the Services for anyone who we reasonably believe has violated these Terms, without notice and without liability.

Third-Party Services

To process your images, we transmit them to third-party artificial intelligence and infrastructure providers acting on our behalf. Your use of the Services is also subject to the way these providers operate their services. For details about the data we collect and share, please see our Privacy Policy.

Output

The Output is generated automatically by artificial intelligence and may be inaccurate or incomplete — for example, parts of the subject may be removed or parts of the background may remain. You are solely responsible for reviewing the Output and for how you use it, including making sure your use complies with applicable law and the rights of others.

Intellectual Property

Apart from Your Content and the Output, the Services and all related software, design, text, graphics, logos and trademarks are owned by Make Image Transparent or its licensors and are protected by applicable intellectual property laws. These Terms do not grant you any right to use our name, logos or trademarks.

Disclaimer of Warranties

THE SERVICES AND THE OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT THE OUTPUT WILL MEET YOUR EXPECTATIONS.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAKE IMAGE TRANSPARENT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICES OR THE OUTPUT. BECAUSE THE SERVICES ARE PROVIDED FREE OF CHARGE, OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD 100).

Some jurisdictions do not allow certain warranties or liabilities to be excluded or limited, so some of the above may not apply to you.

Indemnification

You agree to indemnify and hold harmless Make Image Transparent from any claims, damages, losses and expenses (including reasonable legal fees) arising out of Your Content, your use of the Output, or your violation of these Terms or of any rights of a third party.

Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms on this page and revise the date last updated above. Your continued use of the Services after the changes take effect means that you accept the updated Terms.

General

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Services.
